These Survey Terms and Conditions (referred to as the "Survey Terms") set out the terms of an Agreement by which You, (the "Participant") and Crystal Spring Consumer Division whose registered office is at Unit B7 Millbrook Close, Chandler's Ford, Eastleigh, England, SO53 4BZ ("Crystal Spring"), may participate from time to time in any Crystal Spring product or brand related surveys and related activities as specified by Crystal Spring ("Survey"). You must be at least 18 years of age in order to become a Participant. Crystal Spring reserves the right to change these Survey Terms at any time without notice.
These Survey Terms are effective upon acceptance and govern the Participant's engagement in a Crystal Spring product or brand Survey. If you do not agree to be bound by the Survey Terms, you may terminate the Agreement entered into with Crystal Spring at any time by sending an email to hello@crystalspring.com.
Survey refers to the gathering of feedback from the Participant relating to Crystal Spring and its competitors' products, or health, beauty, and skincare products in general, which may consist of answering questionnaires, survey forms, interviews, or other forms of providing feedback to Crystal Spring about product usage, user preferences, attitudes, and any related topics. The Surveys may help Crystal Spring generate ideas regarding new product development which may ultimately benefit Crystal Spring’s wider customer base. Such Surveys shall be conducted either by means of the telephone, in person by representatives of Crystal Spring, via social media, or through a Zoom/Teams call. If the Survey requires the physical presence of the Participant, Crystal Spring representatives and the Participant shall mutually agree on a time and place where the Survey will take place.
Crystal Spring shall issue the Participant with a Survey. The Participant will be invited to complete the survey and may, at the discretion of Crystal Spring, receive an incentive in exchange for completing the Survey fully and in accordance with the requirements of the Survey and these Survey Terms (an “Incentive”). Incentives may include entry to a prize draw, a direct financial incentive, free products, or some other incentive which Crystal Spring deems appropriate. Any financial Incentives shall be paid by us to you via Paypal, BACS, or such other method as we permit within a reasonable period of time after the completion of the relevant Survey (or, if different, at the time we specify for the relevant Incentive). Upon request, you agree to provide to us details that will allow us to make any relevant payment through Paypal, BACS or such other method as we permit.
The Participant grants Crystal Spring a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, transferable right to use your Survey responses, together with non-identifiable demographic data (including but not limited to age and gender) in any media, including but not limited to its webpages, social media pages, emails, digital advertising, retailer sites, third party sites, and/or its advertising both print and digital.
Crystal Spring may use, display, reproduce, distribute, transmit, combine with other materials, alter and/or edit the Participant’s Survey responses for legal and/or regulatory reasons in any way it sees fit (while maintaining the original sentiment), with no obligation to you whatsoever.
Crystal Spring reserves the right at any time and from time to time to modify, suspend, or discontinue, temporarily or permanently, a Survey or any part thereof, or the Participant’s access to the Survey, including where an Incentive has been offered.
Where the Participant breaches any provision of these Survey Terms, Crystal Spring may declare any accumulated or offered Incentives due to you as null and void and prevent you from receiving them.
Our maximum liability to you in respect of any Survey is the particular Incentive that we agree to provide to you for your participation in that Survey. Only properly and fully completed Surveys that meet the requirements of these Survey Terms and the relevant Survey will qualify for such an Incentive. The Incentive will be subject to all availability and other qualifications that we notify to you at the time.
Where the Participant has not participated in a survey for over 30 days, Crystal Spring may declare any offered Incentives due to you as null and void and prevent you from receiving them.
The Participant acknowledges that Crystal Spring needs to gather and process the following personal data from them in order for the Participant to take part in any Survey: first name, surname, email address, gender, age, household income. Your personal data will only be processed for the purposes of carrying out the Survey, the assessment of the Survey and sending of informative messages by Crystal Spring concerning the Survey and the assessment interviews performed by Crystal Spring. The personal data you provide to Crystal Spring will be processed in accordance with the General Data Protection Act and will be retained for no longer than 12 months. The Participant can terminate this Agreement at any time by sending an email notice to hello@crystalspring.com containing the request to terminate this Agreement, at which time all Survey responses provided by the Participant to date will be deleted or destroyed.
These Survey Terms (and any non-contractual obligations relating to or connected with these Terms) are governed by English law. You and we each agree that the English courts have the jurisdiction for any disputes that arise in connection with these Terms.
The relationship between Crystal Spring and the Participant is independent in nature, and the Participant shall not claim to be a partner, employee, agent, or joint venture partner of or with Crystal Spring or claim any benefits available to the personnel of Crystal Spring under / before any law or forum.
If any part of the Survey Terms is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed to be superseded by the valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Survey Terms shall continue in effect. Unless otherwise specified herein, these Survey Terms constitute the entire terms between the Participant and Crystal Spring and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the Participant and Crystal Spring with respect to the Survey. Our failure to act with respect to a breach by the Participant or others does not waive our right to act with respect to subsequent or similar breaches.
